Concept:
One of the most significant reforms introduced by the Bharatiya Nyaya Sanhita, 2023 is the incorporation of
Community Service as a recognized form of punishment. This reflects a modern shift from purely retributive punishment toward rehabilitation and social responsibility.
Step 1: Traditional punishments under criminal law.
Traditionally, criminal punishments in India consisted mainly of:
• Death penalty,
• Imprisonment for life,
• Imprisonment,
• Fine,
• Forfeiture of property in certain cases.
These punishments focused primarily on deterrence and retribution.
Step 2: Introduction of Community Service.
* The BNS introduces Community Service as a separate form of punishment.
* Under this system, offenders may be directed to perform socially useful work instead of undergoing imprisonment for certain offences.
* The objective is:
• Rehabilitation of offenders,
• Restorative justice,
• Social accountability,
• Reduction of unnecessary incarceration.
Step 3: Why other options are incorrect.
* Solitary confinement existed under earlier penal law and is not an innovative BNS measure.
* Life imprisonment without parole is not the innovation referred to under Section 4.
* Compulsory forfeiture of ancestral property is not recognized as a general punishment under Section 4.
Community Service represents the most notable reformative punishment introduced under the BNS, 2023.
